Terms of Service
The agreement between Facreo Systems LLC and the businesses that use Facreo.
1. The agreement
These terms are between Facreo Systems LLC (“we”, “us”) and the business that opens a Facreo workspace (“you”). By creating a workspace or using Facreo you accept them. If you accept on behalf of a company, you confirm you are authorised to bind it.
2. What we provide
Facreo is a customer relationship and operations platform for real estate. We grant you a non-exclusive, non-transferable right to use it for your own business for as long as your subscription is current.
We may change and improve the product. We will not remove a feature you depend on without notice, and we will not reduce what your plan includes during a term you have already paid for.
3. Accounts and seats
- Each person using Facreo needs their own account. Shared logins are not permitted — the audit trail depends on knowing who did what.
- Your plan sets a seat limit. Adding people beyond it requires moving to a plan that covers them.
- You are responsible for your users’ activity and for keeping credentials secure. Tell us promptly if you suspect an account is compromised.
4. Trial, fees and billing
New workspaces get a 30-day free trial. No card is required to start it, and we do not charge you when it ends — you choose a plan or you do not.
Current plans and prices are on the pricing page. Subscriptions are billed in advance, monthly or annually, through Stripe, and renew automatically until cancelled. Fees are exclusive of tax; where we must collect sales tax we will add it.
If a payment fails you keep full access for a 7-day grace period while it is retried. After that the workspace becomes read-only: you can still see and export everything, but not create or change records. Paying restores full access immediately. We do not delete data because an invoice is late.
You may cancel at any time from billing settings. Cancellation stops the next renewal; it does not refund the current term. We do not give pro-rata refunds for partial periods, but if we have billed you in error we will fix it.
5. Your data
Your data is yours. The contacts, messages, deals and documents you put into Facreo remain your property. We do not sell it, we do not use it to train models, and we do not use it to serve another customer.
We hold it to run the service for you, as described in the Privacy Policy. You can export it at any time. When you close your workspace we delete it within 90 days, apart from records the law or a carrier requires us to keep.
You are responsible for having the right to hold the personal information you put in, and for honouring the requests of the people it describes. Where we process contact data we do so as your processor, on your instructions.
6. Acceptable use
You will not use Facreo to:
- send messages to people who have not consented, or continue after someone has opted out;
- send unlawful, deceptive, harassing or discriminatory content — including anything that violates fair housing law;
- upload lists you bought or scraped rather than earned;
- break, probe or overload the service, or work around its limits;
- resell or white-label Facreo without a written agreement with us.
Messaging carries its own obligations, set out in the Messaging Terms. Carrier rules are not optional and we must enforce them: we may suspend messaging on a workspace that generates spam complaints or fails a carrier audit.
7. Third-party services you connect
Facreo connects to services you choose — your mailbox, your calendar, your phone numbers. Those relationships are yours. We act on the credentials you give us and store them encrypted. We are not responsible for a third party changing its terms, its API, or cutting off your access, though we will tell you when we detect it.
8. Availability
We aim for Facreo to be available whenever you need it, and we monitor it continuously. We do not offer a contractual uptime guarantee on standard plans; Enterprise agreements may include one. We will give notice of planned maintenance that requires downtime.
9. Suspension and termination
You may stop using Facreo at any time. We may suspend or terminate a workspace that breaches these terms, does not pay, or puts the service or other customers at risk. Except for serious or repeated breach, we will warn you first and give you a chance to fix it. On termination we will give you a reasonable opportunity to export your data.
10. Warranties and liability
Facreo is provided “as is”. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Facreo is a tool for running a business; it is not legal, tax or real estate advice, and it does not replace your professional judgment or your brokerage’s compliance obligations.
To the extent the law allows, neither party is liable for indirect, incidental or consequential damages, or for lost profits or lost business. Our total liability under this agreement is limited to the fees you paid us in the 12 months before the claim arose. Nothing here limits liability that cannot lawfully be limited.
11. Changes to these terms
We may update these terms. Material changes will be emailed to workspace owners at least 30 days before they take effect. If you do not accept a change, you may cancel before it applies.
12. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The courts of Bexar County, Texas have exclusive jurisdiction over any dispute.
